Welcome to FieldBull. These Terms and Conditions govern your use of our field service management platform. By accessing or using our services, you agree to be bound by these terms. Last updated: November 28, 2024.

1. Agreement to Terms

By creating an account or using FieldBull, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you may not access or use our services.

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your company.

2. Description of Services

FieldBull provides a cloud-based field service management platform that includes:

• Job scheduling and dispatch management
• Customer relationship management
• Invoicing and payment processing
• Technician tracking and route optimization
• Mobile applications for field technicians
• Reporting and analytics
• AI-powered scheduling assistance

3. Account Registration

To use FieldBull, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• You are responsible for all users you add to your account and their compliance with these terms.

4. Subscription and Payment

Subscription Plans — FieldBull offers various subscription plans with different features and pricing. Details of each plan are available on our pricing page.

Auto-Renewal — Subscriptions automatically renew at the end of each billing period. You may cancel auto-renewal at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Free Trial — We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• Prices may change with 30 days' notice
• You authorize us to charge your payment method on file

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Resell or redistribute the service without authorization
• Use the service to send spam or unsolicited communications
• Collect user data without consent

6. Intellectual Property

FieldBull and its content, features, and functionality are owned by FieldBull and are protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the platform for your business purposes. This license does not include the right to modify, copy, or create derivative works; reverse engineer or decompile the software; remove any proprietary notices or labels; or use our trademarks without permission.

7. Your Data

You retain ownership of all data you input into FieldBull. By using our service, you grant us a license to use, store, and process your data solely to provide and improve our services.

You are responsible for maintaining backups of your data. While we implement robust security measures, we recommend regular data exports.

8. Service Availability

We strive to maintain 99.9% uptime for our platform. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with reasonable notice.

We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "as is" without warranties of any kind
• We disclaim all implied warranties, including merchantability and fitness for a particular purpose
• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless FieldBull and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

11. Termination

You may cancel your subscription at any time through your account settings. We may terminate or suspend your account for:

• Violation of these terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended inactivity
• Upon termination, your access to the service will cease. You may request an export of your data within 30 days of termination.

12. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Francisco County, California.

13. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes via email or through the platform. Your continued use after such notice constitutes acceptance of the modified terms.

14. Miscellaneous

• Entire Agreement: these terms constitute the entire agreement between you and FieldBull
• Severability: if any provision is unenforceable, the remaining provisions remain in effect
• Waiver: failure to enforce any right does not waive future enforcement
• Assignment: you may not assign these terms without our consent
